Terms of Service

These Terms of Service ("Terms") govern your use of Textuoso, which consists of the Textuoso Web app (which runs in a browser on your own device) and the Textuoso Android app (together, the "Service"). By installing, opening, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
Textuoso helps you browse, search, clean up, back up, and restore the SMS, MMS, and RCS messages and their media, call log, and contacts on your own Android device. The Textuoso Web app runs entirely in a browser on your own device. The Textuoso Android app reads and writes data on the device you install it on, at your direction.
2. Early access software
The Service is provided as early access software. It may contain bugs, may change or stop working, and may not behave as expected. Always keep a separate copy of your original backup before making changes. You use the Service at your own risk. Future versions may change backup formats, supported Android versions, supported messaging applications, or available features.
3. Data you give the Service access to
To do its job, the Textuoso Android app accesses data on your device, including the contents of your SMS, MMS, and RCS messages and their media, your call log, your contacts, and your device's own phone number. This data is processed on your device. When you choose to load or transfer it, it is sent directly to a browser running the Textuoso Web app on a device you own (for example, your own computer on the same local network), paired by scanning a QR code, over an encrypted connection. The Service does not send your messages, media, files, call log, contacts, or any of their contents to the developer or to any server, unless you choose to use a third-party service for your backups, as described in Section 5.
Two online services are involved, and neither receives that content:
- a signaling service, which receives only the temporary connection-establishment information needed to help the two devices find each other and set up their direct connection; and
- if you use the Textuoso Web app, an account service, which stores your account details as described in Section 7 and the Privacy Policy.
4. Restoring and erasing data
The Service can write messages, call-log entries, and contacts back to a device, and — only when you explicitly choose a "wipe" option and confirm it — can erase the selected categories of existing data on that device first. These operations modify the data on your device and cannot be undone by the Service. You are solely responsible for choosing what to restore or erase and for keeping your own backups. Do not run a wipe-and-restore against a device whose data you are not prepared to lose.
5. Third-party services and restorability
Textuoso can restore data directly to your device through the Textuoso Android app. You may also export backup files and use them with third-party services — for example, restoring an exported file with a third-party backup-and-restore application such as SMS Backup & Restore (SBR), or storing a backup in a cloud service such as Google Drive or OneDrive. Any such third-party service is outside the Service's control and is governed by that service's own terms and privacy policy. Textuoso does not guarantee that an exported backup will be accepted, imported, or restored correctly by any third-party app, and is not responsible for how those services handle your files.
6. Your responsibilities
- Only use the Service with devices and data that belong to you, or that you are authorized to manage.
- Keep an independent copy of your original backup before making changes.
- Comply with all laws that apply to your use of the Service.
7. Accounts
The Textuoso Web app requires an account. The Textuoso Android app does not.
- You must be at least 18 years old to create or use an account. If we learn that an account belongs to someone under 18, we will delete it, subject to the limited retention after deletion described in the Privacy Policy.
- An account is for one person. You sign in with a one-time code sent to your email address, so you are responsible for keeping access to that email address secure.
- You can delete your account at any time from the account menu in the Textuoso Web app. What is kept afterwards, and why, is described in the Privacy Policy.
8. Purchases
Some features of the Textuoso Web app, such as registering additional phones, may be purchased.
- Stripe is the seller. Purchases are made through Stripe's merchant of record service (shown at checkout and on receipts as "Sold through Link"). Stripe processes the payment, calculates and collects any sales tax, VAT, or GST, and issues your receipt.
- Refunds. Payment questions and refund requests can be made through Stripe's support for your purchase or by contacting us (Section 14). Nothing in these Terms limits any refund right you have under the consumer protection law that applies to you.
- If the Service stops being offered in your country, we will refund purchases made from your account in the 12 months before it stopped being offered there.
9. No warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The developer does not warrant that the Service will be uninterrupted, error-free, or that any data operation will be complete or accurate.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified.
11. Service availability
The developer may modify, suspend, or discontinue any part of the Service — including the signaling service used for pairing — at any time, with or without notice. This is especially likely while the Service is in early access. If the signaling service is unavailable, pairing between devices may not function even though both the Textuoso Android app and the Textuoso Web app remain installed.
12. Changes to these Terms
The developer may update these Terms from time to time. The current version is always available within the Service and at the public Terms URL. When the Terms change materially, you may be asked to review and accept the updated Terms before continuing. Your continued use after an update means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles. This does not take away any mandatory consumer protection that applies to you under the law where you live.
